1. Agreement to Terms
By accessing or using the PlanningAPI UK service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Service
PlanningAPI UK provides access to UK planning application data via API. The data is sourced from publicly available local planning authority records and is provided for informational purposes.
3. API Access and Usage
Subject to these Terms, we grant you a non-exclusive, non-transferable right to access and use the API for your internal business purposes. You agree to:
- Keep your API credentials confidential
- Not exceed your plan's rate limits
- Not resell or redistribute raw API data without authorisation
- Not use the Service for any unlawful purpose
- Comply with all applicable laws and regulations
4. Acceptable Use
You agree not to:
- Attempt to gain unauthorised access to our systems
- Interfere with the proper functioning of the Service
- Use automated means to scrape or overload our servers
- Reverse engineer or attempt to extract source code
- Use the Service to harass, abuse, or harm others
5. Data Accuracy
While we strive to provide accurate and up-to-date planning data, we source information from third-party local authority portals. We do not guarantee the accuracy, completeness, or timeliness of any data provided through the Service. You should verify critical information directly with the relevant planning authority.
6. Payment Terms
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice.
7. Intellectual Property
The Service, including its design, features, and documentation, is owned by PlanningAPI UK. You retain ownership of any applications you build using our API. Planning data sourced from local authorities remains in the public domain.
8. Limitation of Liability
To the maximum extent permitted by law, PlanningAPI UK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless PlanningAPI UK from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted access. We may suspend access for maintenance, security issues, or Terms violations.
11. Termination
Either party may terminate this agreement at any time. Upon termination, your API access will be revoked. Provisions that by their nature should survive termination shall remain in effect.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
